TERMS OF SERVICE

Welcome to Packrats. These Terms of Service (“Terms”) apply when you visit packrats.nl, purchase products from us or otherwise use our website and services.

By placing an order with Packrats, you agree to these Terms. Please read them carefully before making a purchase.

Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

1. ABOUT PACKRATS

Packrats is a collectibles brand offering original collectibles, trading cards, accessories, collaborations and other products.

Throughout these Terms, “Packrats”, “we”, “us” and “our” refer to Packrats.

2. OUR PRODUCTS

We aim to display and describe our products as accurately as possible. However, colours, dimensions and appearance may vary slightly depending on your screen, production process or the nature of the product.

Some Packrats products are handmade or individually finished. Small differences between individual pieces may therefore occur and are part of the nature of these products.

Product availability is not guaranteed until your order has been successfully processed and confirmed.

3. LIMITED RELEASES & DROPS

Certain Packrats products are released in limited quantities or as one-time drops.

High-demand releases may sell out quickly. Adding a product to your cart does not reserve or guarantee the item unless explicitly stated otherwise.

During particularly busy releases, multiple customers may complete checkout at almost the same time. In rare cases, an order may therefore be processed after the available stock has been exhausted.

If we are unable to fulfil your order for this reason, the affected item or order will be cancelled and you will receive a full refund to your original payment method. Please allow additional processing time for the refund to appear depending on your bank or payment provider.

4. ORDERS

After placing an order, you will receive an order confirmation at the email address provided during checkout.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of:

* incorrect pricing or product information;
* suspected fraud or misuse;
* payment issues;
* stock discrepancies; or
* circumstances that make fulfilment impossible.

If we cancel an order after payment has been received, the applicable amount will be refunded.

5. PRICES & PAYMENT

All prices displayed on our website are shown in the currency indicated at checkout and include applicable taxes where required.

Shipping costs and any other applicable charges will be shown before you complete your purchase.

Payment must be completed using one of the payment methods available at checkout.

For international orders, additional customs duties, import taxes or local charges may apply. Where these charges are not collected at checkout, they are the responsibility of the recipient.

6. SHIPPING & DELIVERY

We ship worldwide to the destinations available during checkout.

Orders are generally dispatched within the timeframe stated in our Shipping Policy or on the relevant product page.

Delivery estimates are provided as an indication and may be affected by carriers, customs or other circumstances outside our reasonable control.

7. RETURNS & REFUNDS

Eligible returns can be requested within the applicable return period.

Returned products must meet the conditions described in our Return & Refund Policy. Different conditions may apply to certain products where permitted by law.

Refunds are issued to the original payment method after the return has been received, inspected and approved.

Nothing in our return conditions affects any mandatory rights you may have under applicable consumer law.

8. COLLECTIBLES & PRODUCT VALUE

Packrats products are sold as collectible products and not as financial investments.

We do not guarantee that any product will maintain or increase its value after purchase. Any resale price, secondary-market value, rarity premium or future demand is determined independently of Packrats and may change over time.

Past resale prices or market performance do not guarantee future value.

9. MYSTERY & RANDOMISED PRODUCTS

Some Packrats products may contain a mystery, random or surprise element.

Where applicable, the contents, structure or possible variations of these products will be described on the relevant product page.

Purchasing a mystery or randomised product does not guarantee a particular item, variation, rarity or value unless explicitly stated otherwise.

The outcome of a mystery product alone is not grounds for a refund, except where you have a legal right to return the product or the product is defective.

10. INTELLECTUAL PROPERTY

All content made available by Packrats, including the Packrats name, PUFFS characters, artwork, designs, graphics, photography, videos, product concepts, logos and written content, is owned by or licensed to Packrats unless otherwise stated.

This content may not be copied, reproduced, distributed, commercially exploited or used to create derivative products without prior written permission from Packrats.

Third-party names, trademarks, artwork or intellectual property appearing as part of official collaborations remain the property of their respective owners where applicable.

11. COLLABORATIONS

Certain products may be created in collaboration with third parties.

Any third-party trademarks, names, characters or other intellectual property featured in an authorised collaboration are used with the appropriate permission or licence where applicable.

Unless explicitly stated otherwise, purchasing a collaborative product does not grant the purchaser any intellectual-property or commercial-use rights relating to Packrats or the collaborating party.

12. WEBSITE USE

You may not use our website or services:

* for unlawful or fraudulent purposes;
* to interfere with the operation or security of the website;
* to attempt to gain unauthorised access to our systems;
* to distribute malicious software or harmful code; or
* to infringe the rights of Packrats or any third party.

We may restrict access where reasonably necessary to protect Packrats, our customers or our services.

13. THIRD-PARTY SERVICES

Our website may use or link to services provided by third parties, including payment providers, shipping providers and other technology partners.

Where you use a third-party service, its own terms and policies may also apply.

Packrats is not responsible for third-party websites or services that are outside our reasonable control, except where responsibility cannot legally be excluded.

14. ERRORS & AVAILABILITY

We make reasonable efforts to ensure that information on our website is accurate and up to date.

Occasionally, information may contain errors relating to product descriptions, prices, promotions, availability or other details.

Where permitted by law, we may correct such errors and, where necessary, contact you regarding an affected order.

15. LIABILITY

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to exercise reasonable care.

We are not responsible for losses caused by circumstances outside our reasonable control or for losses that could not reasonably have been foreseen.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

16. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our services, business practices or applicable laws.

The latest version will always be available on this page. Changes will not affect rights and obligations that arose before the updated Terms became applicable, except where required by law.

17. GOVERNING LAW

These Terms are governed by the laws of the Netherlands, without limiting any mandatory consumer protections that may apply to customers residing in another jurisdiction.

Any disputes will be handled by the competent courts in accordance with applicable law.
